Consent Orders

If you are divorced, you have 12 months from this date or if you are in a de facto relationship, you have two years to file an application for consent orders. 

​

Leave from the Court will need to be sought if filing is not within the stipulated timeframe for an application to be filed.

What are Consent Orders?​​​

 

Consent orders are a type of formal arrangement that are applied for when both parties come to an agreement about parenting and/or property arrangements. Consent orders can also be utilised to change or discharge any existing family law orders. ​​When an application is made to the Court, it considers whether the property/financial orders are just and equitable and if the parenting orders are in the best interests of the child.
